APPLICATION FOR GRANT If the District applies to obtain money from any privately sponsored source and if any of the money will pay part or all of any employee's salary, the District must also apply for any legally available funds to pay state contributions to the retirement system as set out in Government Code 825.406(a) and to pay the state contribution to the group insurance program for retired school employees as set out in Insurance Code 3.50-4, Sec. 16.

When the District receives funds to pay for state contributions for retirement and insurance pursuant to this application, it shall immediately send such funds to the retirement system for deposit in the General Revenue Fund of the state treasury. The District shall report monthly to the system, in a form it prescribes, the names of each employee paid in whole or in part from a grant, the source of the grant, the amount of the employee's salary paid from the grant, the amount of money provided for state contributions for the employee by the grant, and such other information as the retirement system deems necessary.

The District shall comply with applicable rules governing examination of its records by the Teacher Retirement System.

FINANCIAL STATEMENT All gifts or bequests shall be included among the total receipts of the District which are reported in the annual financial statement. Local Gov't Code 140.005
PRIVATE DONORS If the District will accept money from private donors or for which there exists a private organization designed to further the purposes and duties of the District, the District shall adopt rules governing the relationship between the organization or donors and the District and its employees.

Rules adopted shall govern all aspects of conduct between the District and its employees in a relationship between an organization or donor and the agency and its employees, including the following:

  1. Administration and investment of funds received by the District for its benefit.
  2. Use of an employee or property by an organization or donor.
  3. Service by an officer or employee of the District as officer or director of an organization or donor.
  4. Monetary enrichment of an officer or employee of the District by an organization or private donor.

PRIVATE DONATIONS A District which is authorized by statute to accept money from a private donor or for which a private organization exists that is designed to further the purposes and duties of the District shall adopt rules governing the relationship between:
  1. The donor or organization; and
  2. The District and its employees.

Rules adopted under this section shall govern all aspects of conduct of the District and its employees in the relationship, including:

  1. Administration and investment of funds received by the organization for the benefit of the District;
  2. Use of an employee or property of the District by the donor or organization;
  3. Service by an officer or employee of the District as an officer or director of the donor or organization; and
  4. Monetary enrichment of an officer or employee of the District by the donor or organization.

A rule adopted under this section may not conflict with or supersede a requirement of a statute regulating:

  1. The conduct of an employee of the District; or
  2. The procedures of the District.

ENDOWMENT FUND The Board may establish an endowment fund outside the state treasury in a depository selected by the Board.

The Board may deposit local funds collected by the Board to the credit of the endowment fund.

The Board may accept gifts and grants from any public or private source for the endowment fund.

The endowment fund consists of local funds deposited to the credit of the endowment fund, gifts, grants, and income from investing the endowment fund.

The Board may invest the endowment fund in securities, bonds, and other investments that the Board considers prudent. In making investments under this section, the Board shall exercise the judgment and care under the circumstances then prevailing that a person of ordinary prudence, discretion, and intelligence exercises in the management of the person's own affairs.

The Board may not spend any money deposited in the endowment fund as local funds, gifts, or grants but may spend any income from investing the endowment fund for the operation or maintenance of the College.

CONDITIONAL GIFT FROM FOREIGN PERSON The Board that receives a conditional gift from a foreign person or his or her agent or representative shall file with the Secretary of State the prescribed disclosure statement in accordance with federal law.

A conditional gift shall be defined as any endowment, scholarship or other gift, donation, or grant of money or property of any kind or any contract award, the use of which is subject to the conditions of a foreign government or person and which conditions relate to what kinds of teachers or students may benefit from such gift or relate to the bias or slant with which subject matter supported by the gift may be taught.
